Members Present: Duane Cerra ( 5 meetings 2013), Edward Conway ( 6 meetings 2013), Rose Wirtz ( 4 meetings 2013), Al Wirtz ( 6 meetings 2013), Robert Dugan ( 6 meetings 2013), Judy Conway ( 4 meetings 2013), Mike Brandl( 6 meetings 2013), and Edward Aschley ( 4 meetings 2013).

Members Not Present:

Visitors: Solicitor Smith, Lorena Adams, & Charles E. Cahall.

Meeting was called to order by Duane Cerra, President at 7:00 pm and a roll call was done.
The Pledge of allegiance was recited.  Everyone was reminded that the meeting was being recorded.
Meeting minutes for the previous meeting were reviewed and changes, if any, were noted.
Motion to accept the minutes: Rose Wirtz  Second: Al Wirtz.
A vote was taken and the motion carried.

Council went in to Executive Session at 7:35 pm and returned at 8:40 pm.
Council went into Executive Session 8:45 pm and returned at 9:55 pm.

Ed Conway asked Tammy Baumgarten for her resignation and she refused. Ed then made the motion to fire her because he felt she was over her head in the position. 2nd: Mike Brandl.
A vote was taken and the motion carried and it was unanimous.

Butler County needs to be contacted about the collection of the taxes. Dana Beers was a write in for tax collector in the spring.  Ed will contact her to see if she wants it.
The Solicitor will need to contact Diane Marburger to see if she would collect County/Borough taxes and see who will collect the school taxes.

Bills paid after last meeting and bills to be paid.

Rose Wirtz made a motion to tabled the financial reports for June 2013 until August. Second: Al Wirtz.
A vote was taken and the motion carried.
Caruso & Caruso will be contacted to do a complete in-depth audit of books from January 1 until June 1, 2013.
Rose Wirtz. Second: Mike Brandl. A vote was taken and the motion carried.
Rose Wirtz made the motion that, if Alice Wahl would come back until the position can be filled at the rate she was being paid when she retired in December 2012.
2nd Mike Brandl. A vote was taken and the motion carried.
Duane wants to know when Alice is coming in , so he can be here. Ed Conway said it might not be until the following Monday because of the holiday.

Borough foreman’s report:
Robert Fiel thanked Jeff Lollo for all the work he has done.
Robert reported that the salt bin is not level.  Jeff got a price of $3,065 for a cement pad to level the salt bin. It will be 24' x 24' x 6" thick.  It cannot be built the way it is and be safe. Ed Conway suggested contacting the engineer as to what is the best depth to do a footer. Rose asked Robert to get a price to do this work with a footer, so it is done right and give the info to Duane so he can contact the rest of council.

A vote was taken and the motion carried.

Committee Reports:

Police: Everyone received a copy of the police report.
        1. Chief Watts said he was aware of the dogs at large as Mrs. Adams stated. The first incident
            is a warning, but he will not tolerate any repeated incidents.  He said there will be charges filed.
        2. The department has been keeping a check on the creeks during the recent storms.
        3. There has been 3 vehicle crashes on Mars-Evans City Road. He trained the new officer on
            investigating crashes.
        4. He had short notice on the double seal, but with Jeff Lollo's help it was handled.
        5. There have been complaints about the trees at the one lane bridge on Kline Avenue claiming
            the trees are obstructing drivers view of the bridge. He spoke with Jeff Lutz and he was going
            to contact Penndot. Penndot came and cut back the trees.
        6. He told council that for some reason domestic violence is up this summer.
            Rose Wirtz made the motion to accept the police report. Second: Mike Brandl.
                      A vote was taken and the motion carried.
Sewer: Rose reported that council is going to meet with Gary Shambaugh with AUS to explain how
          sewage should be billed.
          Solicitor Smith will contact Mr. Shambaugh for a date to meet. 
The sewer ordinance needs amended. A flat fee should be charged for empty houses/ apartments.
The will need to be a basic fee and a usage fee.
Meters may have to be put on the ones that have wells.  The engineer will have to be contacted to see                  what kind of meters should be used.
REV needs to pay for another sewer tap and replaced the sidewalk. A letter needs to be sent to him. Ed               Conway will call the Zoning officer to check that and the fence at McIntrye's.
           Al Wirtz made a motion to accept the sewer report. Second: Bob Dugan.
           A vote was taken and the motion carried.
Zoning: 1.  Ed Conway will contact the Zoning officer of the problems that were discussed.
                  Bob Dugan made a motion to accept the zoning report. Second: Mike Brandl.
           A vote was taken and the motion carried.
Water: A letter needs to be sent to all that are not tap in to the water.
         Al Wirtz made a motion to accept the water report. Second: Bob Dugan.
          A vote was taken and the motion carried.



Solicitor:
    Bob Dugan made a motion to accept the zoning report. Second: Mike Brandl.
           A vote was taken and the motion carried

Correspondence:

Payroll processing bids. This was not discussed because council felt it was not necessary.
  Rose Wirtz made the motion to accept the correspondence. 2nd: Bob Dugan
  A vote was taken and the motion carried.

  Old Business:        

Rose Wirtz made a motion to accept the old business report. Second: Mike Brandl.
A vote was taken and the motion carried.

New Business:
  Chief Watts asked about getting the keys to Alice because she won't be able to get into the office.
  Ed Conway will ask Alice Wahl to return and give her the keys.
  Dave will tell the officers that payroll will be late because Alice needs to get back in here to see
  what all needs done.

Mike Brandl made a motion to accept the old business report. Second: Bob Dugan
A vote was taken and the motion carried.

Public comment ( if any):
1. Mrs. Adams asked about the dogs that are running loose.  Her dogs have been attack twice
   now while she was walking them. Chief Watts said he was aware of the attacks on her dogs
   and said there was a third one that was worse than hers.  He said the owners were made
   aware of what would happen if it happens again. He explained to Mrs. Adams what all he can do.
2. Charles Cahall wanted to know what went on at the sewer meeting. Rose Wirtz told him
   what was discussed.
   A. He questioned the people that are not tapped into the water. He was
      told it is up to Callery borough to take the violators to court @ borough expense. He told council
      that they are not enforcing the ordinances.
   B. He repeated again that he will not pay for the sewer at his house on Kline Avenue.
       It was explained that after 90 days a letter is sent and if not paid in 10 days the owner is
       taken to magistrate.  If it still is not paid then property is liened.
       Ed Conway told council that he spoke with Evans City and if the service is at the property
       then the owners pay for water& sewage. If occupied or not. 
   C. Mr. Cahall was given a copy of the letter from PCS on the dye test on his Kline Avenue property.
   D. He asked about if any action had been taken on Herb Brown for dumping stones on his
       property on Kline Avenue?
   E. He said Foley put up a sign.

With no further business to discuss Bob Dugan made a motion to adjourn. Second: Al Wirtz
A vote was taken and the motion carried.
The meeting concluded at 9:50 pm.
