Members Present: Duane Cerra (9 meetings 2013), Edward Conway (10 meetings 2013), Rose Wirtz (8 meetings 2013), Al Wirtz ( 10 meetings 2013), Robert Dugan ( 10 meetings 2013), Judy Conway ( 6 meetings 2013), Mike Brandl( 9 meetings 2013), and Edward Aschley ( 7 meetings 2013).

Members Not Present:
Visitors: Solicitor Smith, Mike Foley, Ed Miller, Charles A. Cahall, & Charles E. Cahall.

Meeting was called to order by Duane Cerra, President at 7:00 pm and a roll call was done.
The Pledge of allegiance was recited.  Everyone was reminded that the meeting was being recorded.
Meeting minutes for the previous meeting were reviewed and changes, if any, were noted.
Motion to accept the minutes: Rose Wirtz  Second: Judy Conway.
A vote was taken and the motion carried.

Bills paid after last meeting and bills to be paid.
Rose Wirtz made the motion to accept the bills paid after last meeting and the bills to be paid . Second: Judy Conway. A vote was taken and the motion carried.
Alice Wahl told council that she turned the tax records over to Diane Marburger at the County.  Everything was paid and there was a balance of $973.91 in the tax collection checkbook.  Alice
closed the account and put those funds in the general fund account.

Borough foreman’s report:
1. Ed Conway said that the Main Street residents .
2. Mr. Hasenflu is happy with the repairs that Robert did on Euclid Street.
3. Ed Conway said Jeff Lollo will be able to plow snow in the mornings before the school buses come
  through, but he doesn't know about the afternoons.
4. Council was shown the condition of the hot water tank.  Rose Wirtz made a motion to replace the
   hot water tank and remove the holding tank. Second: Al Wirtz. A vote was taken and the motion
   carried. Judy Conway made the motion to use the funds from the tax collection account to replace
   the hot water tank. Second: Robert Dugan.  A vote was taken and the motion carried.
5. Ed Conway presented council with 6 bids for building the new salt shed. The bids ranged from
  $17,575.00 to $21,346.00. Council reviewed all the bids. Al Wirtz made the motion to go with the bid
  from P&W Construction for $17,575.00.  Second: Mike Brandl.  A vote was taken and the motion
  carried.
6. Council asked that Robert do an inventory of the garage.  It will help council know what is there
   and what needs replaced.
7. As of right now Robert knows that a cordless drill and a circular saw is needed.

Rose Wirtz motion to accept Foreman's report. 2nd: Robert Dugan. A vote was taken and the motion carried.

Committee Reports:

Police: Everyone received a copy of the police report.
        1. Chief Watts said that the department will be out during Halloween.
        2. The officers will be going to a domestic violence seminar.
        3. Robert installed a light and light switch in the attic over the police office.
        4. Chief Watts brought in a hand salt spreader for the street crew.
        5. Chief Watts to council he was going to purchase a smart phone.  He explained to council
            that there is an app for the police department that will help him stay on top of what is
            happening in the Borough and the County.  Other departments have it and say it is a very
            good tool. He would like council to pay for the app, he will buy the phone.  Rose Wirtz
            made the motion to purchase and pay for the app.  She also included that the Chief get
            unlimited minutes on his pal and the borough pay for it. Second: Robert Dugan.
            A vote was taken and the motion carried.  He was also told that council would buy the phone,
            but he said he would pay for it that way if and when he should leave he can take the phone
            with him.
       6. The county DUI task force contacted the Chief to see if there was a chance that any of
           his officers would be interested in join the force. Officer Kopas has trained for it and is
           doing very well. The County pays for it and the officer get time and a half for it.
         Rose Wirtz made the motion to accept the police report. Second: Judy Conway.
             A vote was taken and the motion carried.
Sewer: 1. The letter of rates received from Evans City Water and Sewer Authority is going to more
              than double the rates for Callery Borough. The borough needs to set up some by-laws.  It
             was suggested to get a copy of Breakneck's rules and regulations as a guideline.  Then have a
            sewer committee meeting.  Then at the second meeting invite Dan Goncz from Gannett
            and Fleming to discuss it.
           Al Wirtz made a motion to accept the sewer report. Second: Bob Dugan.
            A vote was taken and the motion carried.
Zoning: 1. Ed Conway discussed what they were told at the FEMA meeting about flood insurance.  The
              borough must adopt a New Flood Plan Ordinance by November 2014. Solicitor Smith
              said the borough can meet that time table.
           2. Council voted on the Board of Appeals Ordinance to join with Adams Township.
              Rose Wirtz made the motion to adopt the ordinance. Second: Robert
              Dugan.  A vote was taken and the motion carried.
          3. Rose Wirtz brought up that there is a strong smell of natural gas at the corner of Cherry
             Kline.  She talked to some of the residents that said the gas company was out, but felt
            it wasn't bad enough. She made a motion to send a certified letter to the gas company
            requesting that they return and investigate the situation again. Second: Mike Brandl.
            A vote was taken and the motion carried.
           Rose Wirtz made a motion to accept the zoning report. Second: Robert Dugan
             A vote was taken and the motion carried.
Water: 1. No report.
                Al Wirtz made a motion to accept the water report.  Second: Bob Dugan.
          A vote was taken and the motion carried.

Correspondence:
               1. Appreciation Day is Sunday, October 20th at 11:00 am.

  Judy Conway made the motion to accept the correspondence. 2nd: Bob Dugan
  A vote was taken and the motion carried.

  Old Business:        
                

Bob Dugan made a motion to accept the old business report. Second: Judy Conway.
A vote was taken and the motion carried.

New Business:
  1. Rose Wirtz would like Robert to check Nathan Beer's property.  Water is running off the road
     and into his basement.  She told maybe the water could be rerouted.
  2. Alice Wahl would like to purchase the computer desk that was bought for the tax collector.
    The borough paid $30 for it.  She will pay the $30 to the borough for it. Rose Wirtz
    made the motion to sell it to her for $30. Second: Judy Conway.  A vote was taken
    and the motion carried.

Public comment ( if any):

1. Mr. Cahall provided council with an agreement of a right of way to his property on Kline. 
   It was stated in the past that he didn't have one.
2. Mr. Cahall brought up the Eckenrode property again wanting to know
  why he isn't paying for water & sewage. He said he talked to Mr. Eckenrode to see if council
  had approached him to pay sewage and Mr. Eckenrode had not.
3. Mr. Ed Miller, Mr. Cahall's attorney, said he likes the remodeling Mr. Cahall has made to the
  old Lambert house. He thinks there should be uniformity of laws.
4.  Mr. Cahall feels he is being punished for remodeling that house by being asked to pay for the sewer.
   He said he is paying a maintenance fee for the water. Solicitor Smith explain a maintenance fee could
   possibly be for the borough. Judy Conway made the motion to forgive Mr. Cahall his sewer bill
   and start charging him as of November 2013 a $25 maintenance fee.  Second: Rose Wirtz.  A vote
   was taken and the motion carried.  Mr. Cahall agreed to the maintenance fee.
5. Mike Foley presented council with the drawings of his proposed used of his property on Center Street.
  It is a 2 part development which needs some rezoning.  Rose Wirtz made the motion to advertise that
  before  the December 2nd meeting at 7:00 pm there will be a rezoning hearing with council for
  the property.
  Second: Judy Conway. A vote was taken and the motion carried.

With no further business to discuss Rose Wirtz made a motion to adjourn. Second: Robert Dugan.
