§ 44-1. Fire zone limits.

The Borough of Callery is hereby declared to be a fire zone area.

§ 44-2. Manufacture and sale of explosives prohibited.

Subject to the provisions of § 44-3 hereof, it shall be unlawful to manufacture, sell or store explosive or inflammable substances, materials and/or articles within the area described in § 44-1.

§ 44-3. Exceptions.

A. Notwithstanding the provisions of § 44-2 hereof, it is hereby declared that said prohibition shall not               extend to such articles of explosive or inflammable nature as are customarily and generally in use or         useful in small quantities by homeowners or property owners in said Borough, nor shall it apply to                  service stations.

B. Any other person, firm or corporation desiring to manufacture, sell or store explosive or inflammable           substances, materials and/or articles within the Borough of Callery, and which are not covered by the           exceptions hereinbefore described in this § 44-3, shall first apply to Council for permission so to do, and   shall give the details as to the manner in which said explosive or inflammable substances, materials          and/or articles shall be manufactured, kept, maintained, stored and handled. If Council then finds that the   proposed operation applied for will not be dangerous or hannful to the inhabitants of the Borough of             Callery, it may issue to said applicant a written permit authorizing said operation within the confines of          the Borough of Callery.

§ 44-4. Violations and penalties.1

Every person, finn or corporation violating the provisions of this chapter shall be liable, for each violation, to a fine of not more than $600, plus costs of prosecution, and in default of payment of such fine and costs, to imprisonment for not more than 30 days, and each day that said violation continues shall be considered a separate offense, the same to be for the use of the Borough of Callery and to be collected as like fines and penalties are now by law collectible.
